1. No Guarantee of Profits or Returns - The use of Algo Marketplace offered by Delta Exchange does not guarantee, promise, or assure any profits or returns on investment. All investments carried out via Algo Marketplace are subject to market risks, and the user accepts and acknowledges these risks voluntarily and unconditionally.
2. User’s Sole Responsibility and Risk - The decision to use Algo Marketplace is purely at the user's own discretion and risk. The Company has not and will not influence the user's decision to utilize Algo Marketplace. By accessing and utilizing the services, the user acknowledges that they shall be solely responsible for the outcomes of any trades made, including but not limited to potential losses.
3. Past Performance Not Indicative of Future Results - Past performance is no guarantee of future returns and/or results. Algo Marketplace, like all investment activities, carries inherent risks, and the Company does not make any representations or warranties regarding future performance or success. The user shall be solely liable in this regard for all possible outcomes arising out of such usage.
4. Leverage Trading and High-Risk Exposure- Algo Marketplace on Delta Exchange involves leverage trading, which is inherently volatile and carries substantial risk, including the possibility of losing all invested funds. The level of risk is determined by the user, based on their own research, market analysis, and risk tolerance. The user is solely responsible and liable for the outcomes resulting from their use of Algo Marketplace.
5. Waiver of Claims and Indemnity - By engaging in Algo Marketplace, the user expressly waives any right to make claims for any kind of losses incurred as a result of their participation in the service. The user agrees to fully indemnify and hold harmless the Company, its affiliates, directors, employees, and agents from any liabilities or losses arising out of their use of the service.
6. No Warranty of Services or Error-Free Performance - The Company makes no warranties, express or implied, regarding the fitness, merchantability, or error-free operation of its Algo Marketplace. The services are provided "AS IS," without any warranty or guarantee of any kind. The services may be disrupted due to network issues, technical glitches, slippage, liquidity constraints, or maintenance activities, and the Company shall not be held liable for any such disruptions or any loss of profits or funds resulting therefrom.
7. No Liability for Losses from Leverage Trading - Leverage trading is highly volatile and carries significant risk, with the possibility of losing the entire invested capital. The user acknowledges and accepts that Delta Exchange shall not be held liable for any losses incurred as a result of participating in leverage trading or using Algo Marketplace.
8. Acknowledgement of Terms and Conditions - By accessing or using the Algo Marketplace, the user fully understands and acknowledges all risks, terms, and conditions associated with the service. The use of the service constitutes the user's unconditional acceptance of these terms, and the user waives any rights to claim lack of knowledge or awareness regarding these terms.
9. No Investment Advice Provided - Delta Exchange does not offer investment advice, recommendations, or suggestions to its users. The user is solely responsible for conducting their own research and making informed decisions regarding their investment and trading activities.
10. Automated Trading with No Guarantee of Profit or Capital Protection - Algo Marketplace on Delta Exchange is fully automated, and every trade executed by a strategy will be replicated in the user's account without manual intervention. The user understands that there is no guarantee of profit or capital protection, and any profits or losses will solely reflect the performance of the copied strategy and the market conditions.
11. Risks of Execution Slippage, Liquidity Constraints, and Technical Issues - The user acknowledges that execution slippage, liquidity constraints, network outages, API failures, and exchange maintenance can delay, block, or otherwise disrupt orders. The Company does not guarantee flawless execution and is not liable for any delays or any kind of loss incurred as a result of these factors.
12. Risk of Losses and Investment Guidelines - The user should allocate only discretionary capital for Algo Marketplace and consider diversifying their portfolio to manage risk. The user is encouraged to regularly monitor their trading account and dashboard, and seek independent financial advice if uncertain about their trading strategy. Algo Marketplace does not constitute investment advice or financial guidance.
13. Company’s Right to Discontinue Services - The Company reserves the right to terminate, suspend, or alter the Algo Marketplace at any time for any reason whatsoever, without prior notice, and without any obligation to provide a reason. The user agrees that the Company shall not be liable for any losses incurred due to such cessation or modification of services.
14. Amendment of Terms - The Company reserves the right to amend or modify these terms and conditions at its sole discretion, with or without prior notice to the user. Continued use of the Algo Marketplace service after such amendments shall constitute the user's acceptance of the revised terms.
15. Dispute Resolution and Governing Law- Any disputes, claims, or differences arising out of or in connection with the use of Algo Marketplace shall be subject to the dispute resolution mechanism set forth in the Terms of Service. These terms are governed by and construed in accordance with the laws of India.
16. Complete and Unconditional Acceptance- By using the Algo Marketplace service, the user expressly acknowledges and accepts these terms in their entirety. The user waives any right to contest the validity or enforceability of any of the provisions herein
